A disappointed bidder for an €80 million contract to operate high-tech mobile kidney dialysis units has secured a temporary High Court injunction restraining the HSE from awarding the contract to another company.
Fresenius Medical Care (Ireland) Ltd was also given leave by Mr Justice Peter Kelly, on an ex parte basis, to challenge the decision of the HSE.
Fresenius, with registered offices at Malahide Road, Dublin, had put in a tender for the renal haemodialysis satellite units for Dublin northeast and Dublin mid-Leinster in May of last year. On February 29th, the company was told by the HSE it had not successfully tendered and it was also notified of the HSE’s provisional decision to award the contract to the Beacon Medical Group.
Pat Butler SC, for Fresenius, said the company was contending that the HSE inaccurately marked the tender of Fresenius Medical Care and incorrectly weighted the tender documentation and proposals.
The contract could be worth up to €100 million over a 10-year period, Mr Butler added.
