A Cork man has won his appeal against his conviction for having some €77,000 of cocaine and cannabis resin for sale or supply.

A retrial was ordered in the case of Michael Tanner. The three judge CCA today upheld arguments on behalf of Mr Tanner that his trial had been prejudiced by certain evidence from gardai in relation to Mr Tanner.

Mr Tanner (38), of Casement Street, Clonakilty, west Cork, was convicted in November 2004 of having the drugs for sale and supply on June 2nd 2004. He was jailed for 15 years.

Mr Tanner had denied the charge and claimed he was set up by gardai.
