It has been claimed in the High Court that a Cavan developer who owes €400,000 damages after a site accident to an employee has been selling some of his assets.
Mr Justice George Birmingham yesterday appointed a receiver to take control of all money due to builder developer Paul Curran, of Tarman, Blacklion, Co Cavan, from sales of properties.
Keith O'Grady, for Seán Fee, Cornagee, Blacklion, told the court his client had been badly brain-damaged when concrete blocks had fallen on his head while he was working for Mr Curran, who was uninsured.
He said a settlement had been reached on May 8th before Mr Justice Éamon de Valera in the High Court in Sligo in which Mr Curran had agreed to pay Mr Fee €300,000 damages. It had been agreed that in the event of the money not being handed over before May 17th, that judgment would be entered against Mr Curran in the sum of €400,000, including costs.
Mr O'Grady said Mr Fee's legal team had repeatedly sought payment of the €400,000 but had recently learned that Mr Curran was selling off various assets. Mr Fee had recovered nothing while Mr Curran continued to liquidate sites and properties.
Co Leitrim solicitor Owen Carty said Mr Curran had engaged several firms of solicitors, all in Manorhamilton, Co Leitrim, to deal with his property interests.
Mr O'Grady said the court was being asked to appoint Kevin P. Kilrane, solicitor, Mohill, Co Leitrim, as receiver over Mr Curran's financial affairs pending satisfaction of the €400,000 judgment against him. Judge Birmingham allowed Mr Curran leave on four days notice to seek to have Mr Kilrane's appointment set aside.
