Court clears Dublin man of wife's murder

A Dublin man accused of killing his wife almost ten years ago has been found not guilty at the Central Criminal Court today.

A Dublin man accused of killing his wife almost ten years ago has been found not guilty at the Central Criminal Court today.

John Diver (65) of Kilnamanagh Road, Walkinstown, was acquitted of the murder of his wife Geraldine (42), at Robinhood Road, Clondalkin on December 2nd 1996.

Diver had previously been convicted with her murder in 2000 however that was overturned last year following a decision by the Supreme Court because gardaí had failed to comply with the rules and regulations governing the treatment of people in custody.

Today's jury of six men and five women (the twelfth juror took ill this morning) deliberated for over three hours before returning a unanimous verdict of not guilty. John Diver said "thank you" when the decision was read out.

Ms Diver was found, with a tie around her neck, in the front seat of her car outside a builder's providers around 10.40pm on December 2nd.

Following the verdict a garda inspector said that the case was now closed, and that nobody else was being sought in relation to the death.

Mr Justice Philip O'Sullivan presided.
