Ten people arrested on charges arising from the death of a Swedish man in New Ross, Co Wexford, last summer were freed on bail by the High Court yesterday.
All 10 had been refused bail on Tuesday by Circuit Court Judge John Coughlan, although there was no opposition to bail from the gardaí or the DPP. The proceedings arose after the death of Mr Lars Eric Magnus Forsmark (30), of Pearse Road, Sligo, in New Ross in July 2003. He was in Wickham's pub on Mary Street, New Ross, on July 20th, 2003. He died after a row broke out in the pub about 12.40 a.m.
On Tuesday, publican Seán Wickham (46) and his wife Noeleen (45) were charged with intentionally or recklessly leaving Mr Forsmark in an unconscious and injured state outside the bar, creating a substantial risk of death or serious harm. They were further charged with impeding the Garda investigation.
Eight others from New Ross were charged with violent disorder. They were: Mr Owen Lennon (23), Barrack Lane; Mr Jonathan Bolger (23), Mr Stephen Bolger (27) and Mr Ian Bolger, all of Nunnery Lane; Mr Raymond Kelly (22), Brandon Park; Mr Anthony O'Leary (24), Bosheen Estate; Ms Sinead Kane (18) Bosheen Estate and Mr Jason Murphy (18), Bosheen Estate.
When refusing bail to all 10 on Tuesday, Judge Coughlan had said he was doing so due to the seriousness of the offences.
