London - Mr Neil Hamilton (51) would probably not have lost his cash-for-questions libel action against Mr Mohamed Al Fayed if the jury had known that the Harrods boss had paid £10,000 for stolen legal documents, the Court of Appeal heard yesterday. Anthony Boswood QC, for the former MP, argued that the judge hearing the five week action a year ago, would have discharged the jury and "struck out" Mr Al Fayed's defence if he had known the facts.
Mr Hamilton and his wife, Christine, were present to hear Mr Boswood tell Lord Phillips, the Master of the Rolls, Lord Justice Sedley and Lady Justice Hale that Mr Al Fayed was guilty of "gross impropriety".
