An action by President Mary McAleese's protocol officer in relation to her job in Áras an Uachtaráin is expected to go ahead in the High Court in two weeks time.
The State will now be able to bring a report of an internal disciplinary inquiry to the hearing after a High Court judge yesterday amended a previous order restraining the publication or utilisation of the report.
Bridget Conway, a higher executive officer in the Civil Service, of Oakleigh, Clane Road, Celbridge, Co Kildare has taken an action arising out of her employment in the Office of the Secretary to the President at Áras an Uachtaráin.
In her proceedings, she is seeking a declaration that she is and continues to be the protocol officer in the Office of the President.
She is also seeking a declaration that a purported disciplinary investigation and the circumstances in which it was embarked upon is "tainted beyond redemption".
The proceedings are against An Taoiseach, Ireland and the Attorney General.
Yesterday, Mr Justice Iarflaith O'Neill amended an earlier order granted when Ms Conway was granted leave to mount a legal challenge to the internal disciplinary inquiry.
The order had restrained the publication or utilisation of the report but the judge amended that to permit the report be used in the context of the court proceedings.
Ms Conway now has two sets of proceedings before the High Court.
Last month she was given leave to bring judicial review proceedings seeking an order quashing the decision of the disciplinary investigation carried out late last year.
