A garda on trial for fraud at Dublin Circuit Criminal Court is alleged to have been paid a net sum of £786.04p for overtime he didn't work.
Mr John Kelleher (33), of Mountainview, Cartron Close, Sligo and formerly of Kenilworth Lane, Harold's Cross, Dublin, denies seven charges of obtaining sums of money by false pretences that he had worked all the periods claimed by him.
Mr Eanna Mulloy SC (with Mr Kerida Naidoo), defending, noted that jury members could have made the mistake of believing Mr Kelleher was on trial in relation to £7,182.63p due to the way the indictment was drafted.
The jury heard evidence from two civil servants from the Garda Payroll Section in Killarney. Mr Gerard O'Donoghue told prosecuting counsel, Mr Patrick McGrath, he had been asked to calculate the gross amounts and net amounts received by Mr Kelleher covering 14 days which the prosecution claimed he hadn't worked. He said the net sum was £786.04p.
Earlier, Mr Tom O'Connor agreed with Mr Mulloy that the forms produced in evidence in relation to Mr Kelleher had all been signed by Supt Thomas Conway certifying that the information on them was "correct in every respect".
Mr O'Connor also agreed there was nothing unusual about Mr Kelleher's claims compared with those for other gardaí. The hearing continues before Judge Frank O'Donnell.
