A 12-YEAR-OLD contract for the sale of lands intended for use as a waste management facility in Co Tipperary has been upheld by the High Court.
Mr Justice John Hedigan yesterday granted an order to South Tipperary County Council requiring specific performance of an agreement of January 1996 for the sale to the council of the lands at Hardbog, Co Tipperary, for a price of IR£130,000.
That agreement was made between the council and Bridget Walsh, who died in March 2005. The council had brought its court action against Noel Walsh, her nephew, as the personal representative of her estate. John Walsh, son of Ms Walsh, was joined to the action on the basis that Ms Walsh had in March 2002 purported to transfer her interest to him.
In July 2007, Noel Walsh, in his capacity as personal representative of the estate, agreed to abide by whatever order the court made.
