The High Court today refused an Irish Haemophiliac Society application for leave to challenge a ruling by the Lindsay Tribunal chairwoman not to release confidential papers.

Mr Justice Kelly ruled none of the three grounds put forward by the IHS for leave to review "demonstrated an arguable case" and dismissed the application on that basis.

The IHS sought the application for a review of the ruling not to order the Blood Transfusion Service Board to describe information contained in 611 documents over which the board claims privilege.

In her ruling, Judge Alison Lindsay refused to order the BTSB to describe the documents, stating the onus was on the IHS to prove the BSTB had no right to claim privilege over these documents.
