High Court finds Donal O’Sullivan and Revolution Workwear did not have assets over €5m

A businessman has avoided jail after a High Court judge found it had been impossible for him to comply with a court order made against him.

Mr Justice Paul Gilligan yesterday said Sri Apparel Limited, holder of a worldwide distribution right in Caterpillar clothing merchandise, had brought an application to attach and commit to prison Donal O’Sullivan as he and his company had allegedly reduced their assets under the sum of €5 million in breach of a court order.

The judge ruled the order had never been capable of being implemented or complied with because neither Mr O’Sullivan nor Revolution Workwear had assets in excess of €5million.
