Damages awarded to child who fractured skull in fall from pram

Two-year-old sued Mothercare through his mother, alleging negligence

A two-year-old boy who fractured his skull after falling from a pram when he was only 10 weeks old was awarded €25,745 damages in the Circuit Civil Court on Tuesday.

The court heard that Cameron Baker Daly had woken in his pram when the accident happened on January 12th, 2013 at his home at Forests Field Road, Swords, Dublin.

Circuit Court president Mr Justice Raymond Groarke was told the pram was bought at the Mothercare store in Blanchardstown Shopping Centre, Dublin, six months before the accident and had been stored until Cameron's birth in October 2012.

Barrister Laurence Masterson said Cameron was injured after the left front wheel clipped the kitchen press as the pram was being wheeled from the living room to the kitchen and the chassis folded up in a scissors movement.

He said the pram, from the Mothercare brand range and called “Spin”, then rotated backwards. Cameron slid down and out of it, striking his head on the floor.

He was taken to the Children’s University Hospital, Temple Street, where X-rays revealed a fracture of his skull. He also suffered swelling and bruising to his head.

Through his mother, Nicola Daly, Cameron sued Mothercare (Ireland) Ltd, and also Mothercare (UK) Ltd, alleging negligence.

The court heard that Cameron had fully recovered since the incident and had not suffered any neurological disability.
