A cabin crew assistant on a charter flight who sued over injuries allegedly suffered after slipping on a plastic rubbish bag on the galley floor has settled her High Court action.

Gabrielle McGovern had told the court plastic bags of rubbish were kept on the ground on the galley floor of the 737 aircraft where she worked after security was increased on airlines and the bins on the charter plane were sealed.

“It was an issue with staff. We were moving the bags constantly,” she told Mr Justice Raymond Fullam.

She said she was on a charter flight from Palma to Dublin when she got up from where she had been doing paperwork and slipped, falling forward on her left side.

She claimed she injured her shoulder and back area and later had to have lumbar surgery. Her proceedings also included a claim for loss of earnings as she claimed she has significant pain and can’t work since the incident.

Ms McGovern, Fortlawn Aveneue, Blanchardstown, Dublin, had sued Isle of Man company Air Iom Ltd and Air Contractors (Ireland) Ltd of Malahide Road, Swords, Dublin as a result of the accident on June 26th, 2012.

She alleged failure to ensure rubbish bags were properly secured and could not end up on the floor, presenting a slip hazard. It was also alleged a bag of rubbish was allowed to be discarded on the floor.

The defendants denied all the claims and pleaded contributory negligence on the part of Ms McGovern in allegedly failing to take care for her own safety.

Later on Tuesday, Michael Byrne SC, for Ms McGovern, said the case had settled and could be struck out.
