Judge congratulates opposing parties for taking ‘sensible approach’

An elderly farmer who claimed he received an allegedly defective left hip implant has settled his High Court action.

Patrick Walsh (79), Tinnislatty, The Rower, Co Kilkenny, had sued DePuy International Ltd of Leeds, England. His case has been settled on undisclosed terms and been struck out.

Mr Justice Kevin Cross was also told two separate cases by other plaintiffs against DePuy International in relation to alleged defective hip implants, which were listed for hearing next week and in December, had been settled and could be struck out.

When Mr Walsh’s case was called for a third day of hearing yesterday, Mr Justice Cross was told it had been settled. The judge congratulated the parties for taking a “sensible approach”.

Last week, the judge urged all those involved in legal actions over alleged defective DePuy hip implants to find “innovative ways” to resolve the cases rather than clog up High Court lists. There are more than 70 cases pending for hearing and a total of 1,000 cases in the pipeline.
