Paul Gill accused of assault causing harm to Patrick ‘Patsy’ Kelly

A 35-year-old man has appeared in court charged in connection with the death of another man man in Naas last weekend.

Paul Gill, with an address at Sarto Road, Naas, faces a charg of assault causing harm to Patrick "Patsy" Kelly on August 22nd at Sarto Road.

At Naas District Court, Det Gda Enda Coleman said he arrested Mr Gill on Sunday at 7.24pm . Mr Gill remained silent after being cautioned, the court heard.

Det Coleman said gardaí were objecting to bail as a more serious charge may be brought.

He said the defendant was at the scene of the alleged incident when gardaí arrived. Mr Kelly was unresponsive on the ground and had allegedly been punched and kicked, he said.

Asked by defending solicitor Cairbre Finan if he was concerned the defendant is likely to abscond, Det Gda Coleman said he had no such evidence.

The court heard the defendant is not before the court on any other allegations and there are no bench warrants outstanding.

Applying for bail, Mr Finan said the defendant resides in Naas and has an alternative address which could be used, if this is acceptable. He added he has family in the jurisdiction.

“He is working and has a young family. There is no evidence he will interfere with witnesses and he will abide by any bail conditions,” added Mr Finan.

Judge Patrick Clyne remanded Mr Gill in custody with consent to bail.

Judge Clyne said he would fix bail subject to conditions including that any independent surety be approved by the gardaí and the defendant reside at an address notified to the gardaí. The defendant must sign on three days a week at a pre-arranged Garda station, surrender his passport and use a GPS-activated mobile phone to maintain contact with gardaí.

He said the defendant would be required to produce a bond of €5,000 and an independent surety of €5,000.

Mr Gill is further required to have no contact with witnesses and to stay out of Naas until his next appearance at Naas Courthouse on Thursday.
