The National Monuments (Amendment) Bill 2004 was published today clearing the way for the completion of the M50 at Carrickmines.

The Minister for the Environment, Heritage and Local Government, Mr Cullen, said the legislation was needed to allow the completion of the motorway.

The Bill represents the Government's response to the High Court decision of January 29th which quashed an approval granted by the Minister for the building of the motorway through the site of the medieval Carrickmines Castle.

The new legislation resolves a technicality in relation to the transfer of Ministerial functions which prevented completion of the motorway.

It provides that the Minister will continue to consult with the National Museum on major road projects.

Publishing the Bill, Mr Cullen said: "This Bill has been drafted to address both the immediate consequences of the High Court decision in relation to the Carrickmines site and the longer term implications of that decision.

"It aims to protect heritage, deliver infrastructure and safeguard the taxpayer."
