Lawyers representing Judge Brian Curtin will appear before the special Oireachtas committee inquiring into his conduct tomorrow, with medical records relating to the judge's present state of health.
These were ordered to be produced by the committee at its last meeting two weeks ago.
The committee sought these records following a submission from Judge Curtin's lawyers that he was not well enough to give instructions to his legal team, or to appear before the committee to explain the circumstances leading to his being charged with the possession of child pornography.
The judge spent almost two months in St John of God's psychiatric hospital in Dublin after his acquittal of the charge, and following his arrest on suspicion of drink-driving.
He was charged with this offence before Tralee District Court earlier this month, but the case was adjourned until December.
It is not yet known whether the judge's lawyers will hand the medical records over to the committee, or whether his doctors will give evidence to it concerning his health.
Doctors are bound to observe patient confidentiality with regard to patients' medical records. The judge left St John of God's some weeks ago, and went on holiday abroad.
