An application by the Garda Commissioner to lift a High Court order which stops him from bringing a garda stationed in Cyprus back to the State after a remark to the Minister for Defence, Mr Barrett, at a drinks reception, was adjourned for a week yesterday.

Garda Michael Fitzpatrick was granted an injunction restraining the Garda Commissioner from repatriating him from Cyprus to his station at Carrickmacross, Co Monaghan, in an unprecedented Good Friday sitting of the High Court. The application was made exparte (in the absence of the other side).

The Garda Commissioner is seeking to have the injunction altered or discharged. Yesterday, the motion was adjourned by the consent of both parties until next Monday.

Earlier this month, the Minister, Mr Barrett, was granted an application to be represented in the proceedings.
