A date is expected to be set next month for the hearing of a challenge by the Minister for Justice and his wife to Roscommon County Council's handling of their application for an extension of the duration of planning permission for their new holiday home.
The case was mentioned in the High Court yesterday when it was indicated that the parties hoped to be able shortly to apply to the court President, Mr Justice Finnegan, to see if a date for the hearing can be obtained.
Mr McDowell and his wife, Prof Niamh Brennan, were given leave on October 21st to bring judicial review proceedings challenging the council's handling of their application for an extension of the planning permission for the house at Lavagh, Roosky.
Yesterday Mr Paul Gallagher SC, for the applicants, told Ms Justice Macken that the parties had agreed that submissions would be exchanged by November 29th.
He asked for leave to mention the matter to the President of the High Court then to see if a date for the hearing could be obtained.
Ms Justice Macken said that that made eminent sense.
