Disabled man awarded €1.25m

A severely disabled young man is to receive €1

A severely disabled young man is to receive €1.25 million in settlement of his High Court action against the Health Service Executive over alleged negligence in the circumstances of his birth at a midlands hospital.

The settlement is without admission of liability.

Darren Kavanagh (25), Killiskean, Tullamore, Co Offaly, had through his mother Rita sued the HSE arising out of the circumstances of his birth at the Midland Regional Hospital Portlaoise on January 8th, 1987.

It was claimed Mr Kavanagh, who has cerebral palsy, suffered serious injuries as a result of being deprived of oxygen when his mother developed a complication, a placental abruption, during labour. The HSE denied the claims against it.
