Two Co Limerick doctors who have been charged in connection with the deaths of two Brazilian men in a rented house they own in Gort, Co Galway, are to seek judicial review of the case in the High Court next week.
Erly da Silva (44), a father of two, and Roberto Ramons (27), who had a daughter, were found dead in the rented house at Cloonahaha, Ennis Road, Gort, on December 1st, 2005.
The house is owned by Dr Ralph Keane and Dr Elaine Keane, from Rich Hill House, Lisnagry, Co Limerick.
The Keanes were charged with intentionally or recklessly engaging in conduct in that they failed to service or maintain an indoor oil burner and provide adequate ventilation, which created a substantial risk of death or serious harm to another on a date between November 30th and December 1st, 2005.
The two men who died were both married, and were part of the 800-strong Brazilian population residing in the Galway town.
They had been living in Ireland for less than a year.
At Galway Circuit Criminal Court yesterday, John O'Donnell BL said judicial review proceedings had been drafted.
He said he expected an application would be made by next week.
Judge Raymond Groarke adjourned the matter to November 27th for mention only.
