A Donegal man jailed for the rape of his teenage daughter has lost his appeal against conviction but had his nine year sentence reduced to seven years by the Court of Criminal Appeal.

Desmond Morrison (59) a father of eight of Ballyboe, Rathmullen was convicted in July 2004 of raping his then 16-year-old daughter while they were out walking in a forest near Donegal town in November 1996.

At that trial, the court was told the girl wanted her father named in the media. She said she overdosed on paracetamol tablets shortly after her father raped her and also ran away from home because she wanted to avoid him.

While refusing to overturn the conviction, the CCA said it would reduce the sentence.

The court ruled that the trial judge had not taken sufficient account of either Morrison's age, his lack of previous convictions or the health of Morrison and his wife.
