A Dublin man who reneged on an €80,000 payment to his former live-in lover as her share of the home has been ordered to vacate the house so that it can be sold.

Judge Peter Smithwick, of the District Court, sitting as a Circuit Court judge yesterday, told Mr Joseph Carroll to get out of the house at Mulhuddart, Co Dublin. He also granted leave to the County Registrar to execute a contract of sale and sign any documents necessary to sell the house.

Mr Paul McCarthy, counsel for Mr Carroll's former partner, Ms Karen McDonnell, told the court that on September 20th, 1999, she and her baby daughter had been forced out of their home.

Following court proceedings Mr Carroll had, on October 13th last year, settled her claim for a share of the property by agreeing to pay her €79,315 by December 8th last. When the payment had not been made, it triggered a settlement clause whereby the house would be put up for sale, with Ms McDonnell receiving half of the proceeds.
