TWO BROTHERS have appeared in court on charges of threatening to kill a mother, her son and daughter.
There was a large armed Garda presence at Limerick District Court yesterday for the appearance of Wayne Dundon (33) and his younger brother John Dundon (29).
Wayne Dundon, with addresses at Lenihan Avenue in Limerick and in the UK, was refused bail after an objection from gardaí. The State also objected to a bail application made on behalf of John Dundon, but the hearing ended abruptly after the 29-year-old shouted at gardaí and called Judge Tom O’Donnell a “f**kin’ clown”.
The judge described the outburst as “appalling” but said he would consider bail next week if the application was renewed and the accused was prepared to deal with it in a civil fashion.
Wayne Dundon is charged with threatening to kill a man at an address on Hyde Road, Limerick, on September 30th last. The judge ordered that the names of the alleged injured parties not be published.
In her evidence, Garda Christine Bergin said Wayne Dundon made no reply when he was formally charged at Roxboro Garda station on April 12th.
Shane O’Callaghan of Madden Finucane Solicitors applied for bail on behalf of the brothers.
Mr O’Callaghan told the court that Wayne Dundon’s wife, Ann, who was present for the hearing, had given birth to a baby boy two weeks ago. He said the baby was due to be christened next Sunday and that his client was anxious to attend his son’s christening.
The judge refused bail after hearing evidence from gardaí that Mr Dundon was residing in the UK and had property in Turkey.
Judge O’Donnell said he didn’t wish to sound “disingenuous” but suggested that perhaps the christening could be rescheduled.
John Dundon’s bail application was halted after his outburst at a Garda witness and the judge.
John Dundon of Hyde Road, Limerick, is charged with threatening to kill two women, a mother and daughter, at an address on Hyde Road on April 3rd to 4th.
Garda Denise Moriarty said John Dundon made no reply when he was formally charged at Henry Street Garda station on April 12th.
As she was outlining the State’s objections to bail there was a sudden outburst from John Dundon, during which he shouted: “Go f**k yourself!” at Garda Moriarty and then turned on the judge and gardaí standing beside him.
Judge O’Donnell said he was not “going to put up with that kind of behaviour” and told defence counsel Shane O’Callaghan that he would hear the bail application next week.
He also said he would deal with the question of free legal aid next week and asked that a full statement of means be prepared.
The brothers were remanded in custody and are due to appear before the same court again on April 20th.
