An automobile expert yesterday described a heavily-modified Mercedes coupe as a " monstrosity" which was no longer recognised as a Mercedes by either the motor company or any of its recognised dealers in Dublin.

Mr Andrew Penston, an engineer, told the High Court the second-hand car, which was originally manufactured as a 300 CE automatic coupe, was described on its tax book as a 1000 CE Turbo, although this was not a recognised Mercedes model.

Evidence was given that the car was imported new into this State in its original coupe condition in June 1991.

Mr Daniel Murphy and his wife Caroline, of Marlfield House, Tallaght, Co Dublin, have sued Mr Patrick Jennings, of Ardeen Road, Tullamore, Co Offaly, for the return of £45,000 paid for the car. They are also seeking damages for alleged negligence, breach of duty, misrepresentation and/or breach of contract.

Mr Jennings denies the claim and says he sold the car privately without a warranty. He also denies the car was represented as being roadworthy or that it came with a full service history.

A delay of more than an hour took place when the hearing was due to resume in the afternoon. When the court did resume, Mr Michael J. Durack SC, for the Murphys, thanked Miss Justice Laffoy for her patience and asked that the case be put in for mention on December 16th next when he hoped it would be disposed of.
