Evidence in the action by Fianna Fail TD Ms Beverley Cooper-Flynn, alleging libel in a series of RTE programmes, is expected to conclude this week. RTE journalist Charlie Bird, a defendant in the action and one of the last witnesses in the case, may begin his evidence today. The Co Mayo TD has sued RTE, Mr Bird and a retired farmer, Mr James Howard, Acorn Way, Wheaton Hall, Drogheda, Co Louth. The hearing went into its sixth week and 21st day yesterday with the conclusion of the evidence and cross-examination of Mr Des Peelo, of accountants Peelo and Partners, and also a member of the Institute of Taxation, who was called as a witness by the defence.
Ms Cooper-Flynn (34), Manor Village, Westport Road, Castlebar, who has been a TD since June 1997, has taken the action arising from RTE television and radio broadcasts between June 19th, 1998, and July 1st, 1998.
She claims words used in the broadcasts meant that while working with National Irish Bank she had instigated a scheme intended as a means to evade the lawful payment of tax. The defence denies libel.
The case, before the President of the High Court, Mr Justice Morris, and a jury, will not be at hearing on Friday.
