In the High Court yesterday, a former solicitor was ordered the solicitor Mr Vincent O'Donoghue was not fully answering questions. Mr O'Donoghue was adjudicated bankrupt in 1993. The bankruptcy petition had been taken by the Law Society.
At a previous hearing, he agreed to have accountants draw up accounts to cover June 1998 to May 2000. Since then, four draft accounts had been submitted to the official assignee, Mr Tom Tynan.
Mr Mark Sanfey, for Mr Tynan, said he would apply under Section 24 of the Bankruptcy Act 1988 to ask Mr O'Donoghue to answer two questions. (Where a person fails to answer any lawful question or does not fully answer such questions, he may be committed.)
Mr Justice O'Sullivan said later he was satisfied Mr O'Donoghue answered the questions. He lifted a temporary publication ban but restricted the names of anyone other than Mr O'Donoghue and Mr Tynan.
