A MAN who threatened to kill the mother of his child because he claimed she would not let him see their 14-month-old baby is to be sentenced later in the year at Dublin Circuit Criminal Court.
Wesley Mooney pulled what looked like a gun out of a sock and pointed it at his partner, Kim Murphy, asking her did she want him “to put the three of us asleep together?”
The court later heard that the couple are still in a relationship.
Mooney (27) of Abbotstown Drive, Finglas, pleaded guilty to threatening to kill or cause harm to Ms Murphy at her home in Wood Avens in Clondalkin on December 28th, 2008.
The relationship between Mooney and Ms Murphy had broken up four months prior to the incident, the court heard.
He arrived at 6.30pm at Ms Murphy’s home banging on the door and her younger brother let him in.
Ms Murphy was at the top of the stairs holding their child when Mooney approached her and pulled what she thought was a gun.
Garda Sgt Ernie Henderson told Colm O’Briain, prosecuting, that Ms Murphy was terrified and believed Mooney was going to kill them all. “She attempted to be nice to him as he appeared agitated and he told her, ‘what else would you expect because you won’t let me see the child’, ” said Sgt Henderson.
Ms Murphy’s brother alerted gardaí who arrived and found Mooney sitting at the kitchen table with Ms Murphy and their child.
“He became agitated when we started to search him and we found what looked like a black gun and a balaclava in his coat pocket,” said Sgt Henderson.
The firearm was tested at the ballistics department where it was found to be a black toy cap gun.
“To the untrained eye it looked like a real gun,” said Sgt Henderson.
When Mooney was arrested he initially denied the charge and said he had consumed a large amount of drink and his memory of events was not coherent.
Marie Torrens, defending, said that since the incident Mooney and Ms Murphy have begun seeing each other again.
Sgt Henderson agreed with Ms Torrens that in her victim impact report, Ms Murphy said that she had not suffered any long-term effects.
“They are still in a relationship and Ms Murphy is now expecting her second child with him,” said Ms Torrens.
“He had a number of problems in 2008, and on the day he had taken drink and drugs and Ms Murphy had said she had never seen him in such a state before,” said Ms Torrens.
Judge Patricia Ryan adjourned sentencing until March for a probation report.
