A COMPANY is suing a businessman for some €5

A COMPANY is suing a businessman for some €5.7 million allegedly due to it for mobile phone handsets and other accessories supplied to another company.

20:20 Logistics Ireland Ltd, of Sandyford Industrial Estate, Dublin, has brought its action against Emmet Memery, of Northumberland Road, Ballsbridge, Dublin.

The case arises from a guarantee and indemnity allegedly executed by Mr Memery in July 2005 under a contract between 20:20 Logistics and Cellular Services, formerly Cellular Services Ltd, with registered offices at Haddington Road, Dublin, for the supply of Vodafone approved mobile phone handsets and other mobile phone accessory products.

It is claimed some €5.7 million is owed by Cellular for products supplied between July and December 2008 and that, under a guarantee and indemnity, the plaintiff is entitled to seek such sums from Mr Memery. Demands for payment were made in December and January last but no sums had been paid, it is claimed.

When the proceedings were admitted to the Commercial Court yesterday by Ms Justice Mary Finlay Geoghegan, Paul Fogarty, for Mr Memery, said his side may well have a defence to the bulk of the claim. The judge listed the matter for next month.
