A file relating to a Garda investigation into a car incident involving a former garda is to be made available under court order to Circuit Court president, Mr Justice Matthew Deery.

At the Circuit Civil Court, Mr Justice Deery directed the Garda authorities to release the file, which was said by Garda Supt Stephen Courage to contain statements relevant to a damages claim by Stephen Cooper against the Motor Insurance Bureau of Ireland and car owner Tony Lupton.

Mr Cooper (27) alleges his back was injured when a car owned by Mr Lupton, Latchford Green, Clonee, Co Dublin, crashed into the BMW in which Mr Cooper was a passenger and which was being driven at the time by Philip D’Arcy, now with an address in Australia, and who has been joined as a third party in Mr Cooper’s claim.

Mr Cooper, Kingswood Heights, Tallaght, Dublin, alleges that the unidentified and untraced driver of Mr Lupton’s car, which Mr Lupton claims had been stolen, had fled the crash scene on March 4th, 2010. The claim was to have been heard yesterday but was adjourned.
