A garda accused of dangerous driving causing death has been cleared of the charge in Dublin Circuit Criminal Court by order of Judge Michael White.

The judge told the jury to find Garda James O'Gorman, of Lucan Garda station, not guilty following a submission from his defence counsel, Mr Brendan Grehan SC, that there was not sufficient evidence of the 2002 accident to convict his client of the charge.

Judge White told the members of the jury that, if he allowed them to retire to consider the verdict, it was his belief that a guilty verdict would be an unsafe conviction for Garda O'Gorman.

He expressed his sympathies to the family and friends of the late Ms Margaret Boggins and to her partner, Mr James Molloy, the driver of the other vehicle.
