A jury at Waterford Circuit Criminal Court last night found a garda guilty of the harassment of a woman and the theft of her underwear.

Garda Anthony Fennelly (39), Moonvoy Bridge, Tramore, was found guilty of harassment on and between November 12th and 15th, 2003.

He is to be sentenced on a later date.

He was also found guilty of the theft of underwear on September 16th, 2003.

During the trial, the jury heard how in December 2001, Garda Fennelly, a father of two children, and his then pregnant wife Shirley attended a meal with her work colleagues at the Jade Palace restaurant in Waterford city.

While there, Garda Fennelly made unwanted advances towards Amanda Cox (28), Rathfadden Park, Waterford. He apologised for his actions days later and was told to forget the matter by Ms Cox.

In September 2003, Garda Fennelly, claiming to be responding to reports of an intruder, gained access to Ms Cox's house through a neighbour.

Ms Cox received reports that a garda had jumped over the wall into her back garden. Items of underwear were understood to have been stolen from her washing line.

The jury also heard how Ms Cox was woken from her sleep by numerous phone calls on the evening of November 13th and early hours of the 14th in 2003. She learned that fliers falsely advertising her as a prostitute were placed in a number of phone booths in the city.

Fliers, similar to the ones distributed in the phone booths, were found in a photocopying machine at Waterford Garda station.

Det Sgt Michael Wall, giving evidence of a technical examination, identified the fingerprints on the fliers as belonging to Garda Anthony Fennelly.
