The Labour Party has written to the Garda Ombudsman Commission requesting it to formally initiate an investigation into the circumstances of the death of Derek O'Toole in Lucan village on Sunday, March 4th.

Labour's Seanad spokeswoman on justice, Senator Joanna Tuffy, has written to the ombudsman asking for an inquiry under Section 102 (4) of the Garda Síochána Act, 2005.

Ms Tuffy said she was aware the commission did not plan to commence operations until May, but added that she believed "that the public interest would be served by the commission acting now to hold an investigation under the 2005 Act".

Ms Tuffy said Mr O'Toole was a young man of exemplary character, who had courageously overcome a variety of serious health problems.

She said the O'Toole family allege that they were not initially told by investigating officers that the car involved was driven by a member of the force and discovered this information only through the media.

"I am not making any allegations against either the driver of the car or against any of the officers involved in the investigation. However, I believe that there are serious public concerns about this incident and the subsequent investigation that can only be properly allayed by a full independent investigation by the Garda Ombudsman Commission," the letter concluded.
