The Christian Solidarity Party has accused the Referendum Commission of circulating a factual inaccuracy in its literature concerning the death penalty.

The party took exception to the statement that if the 21st Amendment to the Constitution was adopted, the effect would be "to prohibit, absolutely and in all circumstances, any law permitting the imposition of the death penalty".

This, the party claimed, was demonstrably false because the proposal in the Bill was merely that "the Oireachtas shall not enact any law providing for the imposition of the death penalty".

This would not prevent a superior body to the Oireachtas from imposing such a law or a sentence of death being passed on an Irish citizen by the International Criminal Court or by the European Court of Justice, a statement from the Christian Solidarity Party said.
