If you are disabled, your disability should not be used as a reason for singling you out for a health test without good reason.
Equality legislation prohibits discrimination on the grounds of disability, according to Dr Martin Hogan, of occupational health and hygiene consultants, Employment Health Advisors.
However, it is not always unlawful for an employer to ask a disabled person to have a health check as it will depend on the nature of the disability and the needs of the job.
"There are very few conditions that would prevent someone working in any job and mostly these are obvious," says Hogan.
"Some jobs have particular standards, mostly on grounds of public safety, such as fire fighters, train drivers, sea farers and, where such standards exist, a failure to pass the medical is more common."
