The High Court has rejected a challenge to the Intoxilyzer breath test which is being used by gardaí to test alcohol levels in suspected drink-drivers.
The ruling by Mr Justice Peter Kelly will allow hundreds of drink-driving cases which were adjourned pending today’s outcome to go ahead.
It was argued that the Lion Intoxilyzer, which makes blood and breath tests by a doctor in cases of suspected drunk-driving unnecessary, had not been approved by the Medical Bureau of Road Safety.
The ruling may be appealed in the Supreme Court.
