The Transport Museum in Howth, Co Dublin, yesterday won a legal challenge against a decision by the Registrar of Friendly Societies compelling it to pay rates on its premises.

In the High Court, Mr Justice Geoghegan upheld a Circuit Court decision that the Transport Museum Society of Ireland Ltd was a society instituted exclusively for the purposes of science, literature or the fine arts, and was therefore entitled to a certificate under the Scientific Societies Act 1843 exempting it from payment of rates. He was delivering his reserved judgment on an appeal by the Registrar of Friendly Societies against the Circuit Court finding.

Mr Justice Geoghegan dismissed the appeal.
