Two 11-year-olds were left in charge of a class of 30 toddlers in a Co Dublin school, the Circuit Civil Court heard yesterday.

William O'Brien, counsel for Rory Doolin (10), Mountain View, Tallaght, said Rory's class had been confined to their classroom during a break because the day had been wet. He told Circuit Court president Mr Justice Matthew Deery that supervision consisted of two 11-year-olds from sixth class.

"It appears Rory, who was then only five years old, climbed on to a table or chair and either fell or jumped off it, breaking his right leg," Mr O'Brien said.

The board of management of Saggart national school had made a €17,500 settlement offer and he recommended the court approve it.
