Court reserves judgment on challenge to passport law

The High Court has reserved judgment on a challenge by a west African woman to the constitutionality of provisions of the Immigration Act making it a criminal offence for a foreign national to fail to produce, without satisfactory explanation, passport or other identity documents.

Liberian national Ebere Dokie (40) is facing charges under section 12 of the 2004 Immigration Act arising out of her arrest at Dublin airport in April 2008, when she and three children attempted to enter the State without passports. The court was told Ms Dokie had met two of the children the previous day and had agreed to take them to Ireland.

Firm admits fatal safety lapses

A construction firm has admitted breach of health and safety regulations, leading to the death of an employee.

Concast Precast Limited, represented by company secretary Bernard Quinn, pleaded guilty at Dublin Circuit Criminal Court to failing to provide a safe work environment at Hazelhatch Road, Newcastle, Dublin, on April 4th, 2008, leading to the injury and death of Adrian Mihoc.

Sentencing was adjourned until May.

No damages for pest controller

A pest controller, who was called to an 84-year-old woman’s home to clear bees from the attic, has failed in a damages claim against her after an attic ladder broke.

William Farrell (60), of Rathdrum Road, Crumlin, Dublin, is now faced with legal costs of almost €20,000 after losing his claim against Betty Doyle, of Butterfield Avenue, Rathfarnham, Dublin and the HSE.Mr Farrell had failed to fully extend the ladder, the judge found.
