Couple consent to judgments against them for property loans
A couple who borrowed to buy nine investment properties have consented to summary judgment orders for some €2.9 million and €2.5 million being entered respectively against them at the Commercial Court, writes Mary Carolan.
Mr Justice Peter Kelly granted the orders to Ulster Bank Ireland yesterday against Patrick Joseph Daly and Rachel McGrath, Fir Tree Cottage, Rocky Valley Drive, Kilmacanogue, Co Wicklow. The proceedings arose after €2.3 million was advanced to the defendants by the Athlone branch of First Active plc – predecessor to Ulster Bank Ireland – between December 2004 and May 2008. A further €386,900 was advanced to Mr Daly alone via a loan offer in December 2004.
McInerney companies directed to exchange documents on examinership
The Commercial Court has directed parties involved in the McInerney construction group examinership to exchange information in time for a hearing before Christmas.
Mr Justice Peter Kelly said this should be done prior to the full hearing before Mr Justice Frank Clarke on December 20th. He continued court protection for the relevant companies to that date. The examiner, William O'Riordan, has prepared a report for presentation to the court, and a schedule of other relevant material was being supplied, Eoin McCullough, for Mr O'Riordan, said yesterday.
The McInerney examinership is now only dealing with two of the five companies which filed for court protection last August.
Yesterday, Rossa Fanning, for a syndicate of three creditor banks which oppose examinership and are owed €116 million by McInerney, said he was not satisfied with the schedule for exchange of documents. John Hennessy, for the two McInerney firms, said they were supporting the examiner's schedule.
Hearing on €25.3m liability adjourned
A High Court judge has adjourned a hearing to determine liability for €25.3 million of unpaid loans advanced by AIB to seven persons to buy lands in Co Waterford.
Mr Justice Peter Kelly refused to grant AIB summary judgment against Gerard Conlan, of Bridalwood House, Forenaughts, Naas, Co Kildare, one of the seven, because details in separate proceedings by the other six persons, of the Lynch family, could be relevant to claims against Mr Conlan. He ruled proceedings against all seven should be heard next March.
