Two Wexford men deny raping woman
Two Wexford men have gone on trial at the Central Criminal Court accused off forcing their way into the home of a young woman and taking turns to rape her as she was restrained by a rope around her neck.
A 25-year-old man has pleaded not guilty to three counts of raping the woman at her Waterford home on August 31st, 2006. His 22- year-old co-accused denies raping her on the same occasion.
The now 24-year-old woman told Thomas Creed SC, prosecuting, that she was at home with her small child in the afternoon when she heard a knock on her front door. She said there was one large and a smaller man there looking to sell her a camcorder and she told them she was not interested.
She said she was pushed into a bedroom and when she refused to take her clothes off the large man punched her to the side of her face before she was raped by both men.
The woman told Ciarán O'Loughlin SC, defending the 25-year-old, that certain magazines and DVDs found in her house were freely available "on the top shelf of newsagents".
She agreed that she had previously made a complaint of sexual assault against a young man and said he had been found not guilty on appeal "due to lack of evidence".
The woman disagreed with John Phelan SC defending the 22-year-old, that it was unusual for a mother to have adult material such as men's magazines around the house.
She said she would lock the bedroom door when her boyfriend stayed over and said her child would not have access to the pornographic material. She agreed she had left her child alone "for five minutes" to go to the shop.
She denied a suggestion by Mr Phelan that she had consensual sex with his client. She said she did not go straight to the gardaí because "I went through this once before and the law went against me".
The trial continues before Mr Justice George Bermingham and a jury of seven men and five women.
Court told of feud in murder case
A jury at the Central Criminal Court has heard of an altercation between the brother of a man who was shot dead in Dublin last year and a friend of the man accused of his murder.
Bryan Ryan (24), an unemployed man originally from Sheepmore Crescent, Blanchardstown, has pleaded not guilty to the murder of Ian Tobin at Fortlawn Park, Blanchardstown, on May 27th, 2007.
It is the prosecution's case that, as a result of an ongoing feud, Mr Ryan drove a motorbike with another man, Michael Murray, who was carrying a gun, and that Mr Murray shot Mr Tobin in the neck.
The prosecution says that Ian was not the intended target and that his brother, Blake, was. The trial resumes on Monday afternoon.
Man remanded on drugs charge
A man has been remanded in custody with consent to bail after he was charged yesterday in connection with a €500,000 cannabis seizure by gardaí in north Cork on Wednesday night.
Aidan Crowne (30), Norwood Court, Rochestown, Cork, was charged with seven offences including possessing cannabis for sale or supply following the seizure of 63kg of cannabis at Kilquane, Castletownroche, on November 19th.
Judge Michael Pattwell at Mitchelstown District Court remanded him in custody with consent to bail to appear at Fermoy District Court on November 28th.
