Hurler's case against paper struck out

A case taken by an intercounty hurler against a newspaper over the unauthorised use of his image in promotional material was struck out yesterday.

In what was believed to be the first case of its type, Clare hurler Diarmuid McMahon, of Brookfields, Shannon, was seeking damages from the Clare Peoplearising from the paper placing his image on promotional material in April 2005 ahead of the launch of the newspaper.

Mr McMahon claimed he was entitled to restrict his image or personality and in particular where it was being used for commercial gain.

Ennis District Court heard yesterday that the matter could be struck out on consent and no order was made on costs. No reason was given.

Further remand in murder case

A man charged with murdering a Sligo teenager whose remains were found in a lake earlier this year, was further remanded in custody yesterday.

Ronnie McManus Dunbar (43), Rathbraughan Park, Sligo, is accused of murdering 14-year-old Melissa Mahon at his home on a date unknown between September 14th and 30th, 2006. The schoolgirl had been reported missing by her family in September 2006.

Last February gardaí acting on information found human remains in Lough Gill near Sligo.

DNA testing and dental records confirmed that they were the remains of the missing teenager.

Man freed in pet cruelty case

A man who was prosecuted for cruelty to 22 pet rabbits in a Co Louth house avoided a conviction at Dundalk District Court yesterday.

Michael Mockler O'Neill (69), St Mary's Road, Dundalk was accused of ill-treating the animals by leaving them without adequate food or water between June 14th and 23rd, 2006.

The court heard in February that the defendant had paid the agreed donation of €500 to the ISPCA.

Injured French girl transferred

A nine-year-old French girl who lost her 12-year old sister in a road crash near Louisburgh, Co Mayo, earlier this week has been transferred from Mayo General Hospital, Castlebar to Temple Street hospital, Dublin. Chiara Kahn, from

Avenue Marcel Doret in Paris, was said yesterday to be in a critical condition.

Pauline Kahn, Chiara's older sister, was killed and her parents Laurent and Antoinella Kahn were injured when their car collided with a Landrover near Old Head, Louisburgh on Tuesday.
