Bill on child detention to be drafted

The Government is to give the High Court the exclusive power to rule on detention orders for seriously disturbed children under legislation to be drafted in the coming months by Minister of State for Children Brendan Smith.

Several dozen children are locked up every year for their own protection in secure accommodation such as Ballydowd in Dublin for periods as short as several weeks, or as long as a year, if they are deemed "at risk" by the courts.

Last year, Mr Justice John McMenamin ruled that the High Court had inherent power to detain troubled children in "long-term" secure care where evidence showed such detention was necessary for their welfare.

Before Mr Justice McMenamin's ruling, the Health Service Executive argued that the High Court did not have power to make long-term secure care orders, because "long-term" had not been defined and it would interfere with constitutional rights.

Inquest told driver had taken cocaine

A 23-year-old man who crashed his car killing himself and a cyclist had taken cocaine on the night he died, a coroner's inquest was told.

Barry Dunne, from Casana View, Howth, Co Dublin, was driving on the wrong side of the road when he first hit a cyclist and then smashed into a taxi shortly after attending a cousin's wedding in March last year.

Thomas Masterson (61), a father of two, died instantly after the crash. He had been cycling home after a night out on March 26th, 2006.

Dublin city coroner Dr Brian Farrell said he was sorry to tell Mr Dunne's family that toxicity reports showed their son had a level of cocaine "consistent with recreational use".

Woman's body taken from sea

Gardaí in Co Mayo are trying to identify the remains of a woman in her 50s which was discovered in the sea at Lecanvey, Louisburgh, yesterday.

The body was taken to Mayo General Hospital in Castlebar for a postmortem examination.

A person walking on the shoreline found the body around 9am. Gardaí say they are not treating the death as suspicious.
