A sworn inquiry into the circumstances of the death of a 14-year-old schoolboy, who fell unconscious while in Garda custody and subsequently died, started hearing evidence this morning.

Hugh Hartnett SC began taking sworn testimony into all the circumstances surrounding the arrest and overnight detention of Brian Rossiter in Clonmel Garda station on September 10 thand 11th, 2002.

The boy was found unconscious in a cell in the station on the morning of September 11th, 2002, following his arrest on suspicion of a public order offence the previous night.

He died in Cork University Hospital on September 13th.

The inquiry, in private, is due to last three months. It was established by Minister for Justice Michael McDowell.

The Rossiter family have said that while they are not happy with the terms of reference of the inquiry, they are willing to co-operate.
