A judge yesterday directed a jury to find a former engineer with Waterford County Council not guilty of awarding a kerbing contract “dishonestly by deception” in Dungarvan in 2002 due to a lack of evidence.

Joseph Brennan (50), of Ceithre na Gaoithe, Ring, Co Waterford, faced the charge under the Fraud Act at Waterford Circuit Court. The trial started on Wednesday and was halted yesterday morning.

The charge related to the awarding of a contract worth €18,920 plus VAT for works from the Park Hotel roundabout at the N25 in Dungarvan to a housing estate at Shandon.

Judge Tom Teehan yesterday morning directed a jury of six men and six women to find Mr Brennan not guilty.
