A man from Co Wexford who threatened to kill another man has been sentenced to three months in prison at Enniscorthy District Court for threatening to kill another man.

Seán Carroll, Castlebridge, Co Wexford, had denied threatening to kill Robert Pask at his home at Gragreen, Killinick, last September.

Mr Pask was admitted in evidence as a hostile witness after withdrawing the original complaint he made in June last year.

Judge Donnchadh Ó Buachalla said a threat to kill somebody was the most serious threat that could be made. "I'm satisfied the person found the threat to be of utmost seriousness at that time," the judge said. "The court will not tolerate a threat being made."

He took into account that Mr Pask felt the threat no longer existed against him or his family, but convicted and sentenced Carroll to three months in prison.

The court heard that in his original statement to gardaí, Mr Pask said he was awoken at about 7am on the date of the incident by Carroll, his first cousin, who said it had all come out about Mr Pask and Carroll's sister. Mr Pask alleged that Carroll said he was a dead man and that he wouldn't "be doing it but there are lads on the way over who will".

In the statement, he admitted having been involved in a short sexual relationship with Carroll's sister Sharon. Mr Pask agreed to the court that the facts in the statement were correct.

Judge Ó Buachalla allowed the defendant bail in case of an appeal.
