A WOMAN who claims she was infected with the hepatitis C virus from infected blood contends the Blood Transfusion Service Board and the State have documents which should be made available to her lawyers, the High Court was told yesterday.
The woman is suing the Blood Transfusion Service Board (BTSB), the Minister for Health, the National Drugs Advisory Board, Ireland and the Attorney General.
The President of the High
Court, Mr Justice Costello, yesterday adjourned the hearing until next Monday. Mr Justice Costello is to decide on the issues to go before the judge who will hear the action. He will also decide on any applications made about the discovery of documents.
It is claimed the BTSB used plasma from a female plasma exchange patient who, to its knowledge, had been clinically diagnosed as suffering from infective hepatitis and had become jaundiced.
Mr Michael Cush, counsel for the woman, told Mr Justice Costello yesterday that the BTSB had made supplemental discovery of documents in accordance with last month's court order.
There was an issue concerning documents which the woman contended ought to have been discovered by BTSB and a claim by BTSB for general privilege in relation to documents. The matters could be adjourned until next Monday, he said.
