The trial of Brian Kearney, who is accused of murdering his wife, is due to continue today after it was adjourned yesterday in order for an ill jury member, who was absent, to recover, the Central Criminal Court in Dublin has heard.
Mr Kearney (50), Carnroe, Knocknashee, Goatstown, Dublin, has pleaded not guilty to murdering his wife, Siobhán Kearney (38), on February 28th, 2006 - his 49th birthday.
Mr Justice Barry White told the 11 jury members who were in court yesterday that the ill juror would be available this morning, having been given the all-clear. He said the absent juror was advised to rest for the afternoon and that she was "anxious to continue as a juror".
Earlier, Mr Justice White told the court that inquiries were being made to a maternity hospital as to whether the absent member could continue to sit on the jury.
He said that legislation allowed for a trial to proceed with fewer than 12 and that the jury can be as few as 10 but that he was "anxious to have a full jury of 12 if at all possible".
