Controversial businessman Mr Jim Kennedy is facing the seizure of a multi-million euro payout for lands that were acquired for the South-Eastern motorway.

The Criminal Assets Bureau is expected to block any attempt by Mr Kennedy to collect compensation due to his company, Jackson Way, for land at Carrickmines, Co Dublin, that was compulsorily acquired for the motorway, The Irish Times has learned.

Mr Kennedy, who has refused to co-operate with the Flood tribunal, featured in last night's Primetime programme on RTÉ television. Confronted by the cameras near his home in the Isle of Man, he declined to comment on allegations that he bribed councillors to secure the rezoning of the Carrickmines land.

He described Mr Frank Dunlop allegations as "hearsay" and went on to describe Mr Dunlop as a "gangster".

Jackson Way is seeking €47 million compensation for the 20 acres acquired by Dún Laoghaire. An arbitrator is due to decide shortly how much the company should get for the land, for which the council has offered €7.6 million. Jackson Way is at least 50 per cent owned by Mr Kennedy. CAB officers have visited the Isle of Man several times in an effort to interview Mr Kennedy, but he has refused to co-operate.

Mr Kennedy is registered for tax purposes in Gibraltar, where he owns a penthouse apartment. He also owns a €4 million property on the Isle of Man. It is believed his other assets in Ireland are registered under his wife's name, which means it would be difficult for the CAB to confiscate them.

Under proceeds-of-crime legislation, the CAB could argue that any money awarded to Mr Kennedy was the product of corruption in the planning process and therefore the proceeds of crime.
