LAWYERS FOR RTÉ broadcaster Pat Kenny have complained that Mr Kenny's neighbour excluded important photographs from documents discovered for a High Court action, due to open today, over the ownership of a plot of land adjoining their homes in Dalkey.

On foot of that complaint, Brian O'Moore SC, for Mr Kenny and his wife Cathy, of Bulloch Harbour, will ask the court to dismiss the claims against them by retired solicitor Gerard Charlton.

The full hearing of the dispute between the two sides is due to open at the High Court today and is expected to last four weeks. However, that is now dependent on the outcome of the Kennys' application, to be made this morning.

Mr Charlton and his wife claim to be the legal owners of the disputed land, a rocky outcrop known as Gorse Hill.

However the Kennys contest the Charltons' title and claim any title the Charltons may have had to the property has been extinguished by adverse possession (squatters rights).

Mr Charlton of Maple Trees House, Harbour Road, Dalkey, has rejected the Kennys' claim they have squatters rights to the lands.
